Part 76: Claims Administration
(Project Procurement Management: Control Procurements)
- A Contested Change occurs when the buyer requires changes to the procurement, but the buyer and seller do not agree on the compensation for the change, or when they do not agree that a change has occurred
- Contested Changes are also called claims, disputes, or appeals
- If the parties cannot resolve a claim, we use the Claims Administration Tool
- The parties may resort to Alternative Dispute Resolution (ADR) or court, in accordance with their contract
- Forms of ADR
- Mediation (a third party helps the parties negotiate)
- Arbitration (a third party makes a binding decision to resolve the parties’ dispute; this decision is enforced by the court)
